Acceptance of the Terms
Welcome to Gaby II, your boat rental service for sport fishing. By booking, paying for, or using any of our services, you, the customer ("You"), fully accept these Terms and Conditions (T&Cs) and our Privacy Policy. These T&Cs govern the contractual relationship between the Provider and You. We reserve the right to modify these terms at any time. It is your responsibility to review the most recent version before each booking.
Description of Services and Capacity
​The provider offers sport fishing excursions on the Gaby II. Our services include boat rental for the agreed-upon duration (4-7 hours), the services of a qualified captain and crew, fuel, basic fishing equipment, and necessary bait. Exclusions: Gratuities, food and beverages not specified in the package, and transportation to the dock are not included. The maximum passenger capacity is 15 people. This capacity must be strictly respected for safety reasons.
Reservations, Payments and Prices
To confirm any reservation, an initial deposit equal to the total cost of the tour is required. The deposit is non-refundable and must be paid in full before boarding on the day of the tour. All prices are in Mexican pesos (MXN) and are detailed at the time of booking. Availability is not guaranteed until the deposit is received.
Cancellation and Refund Policy

Cancellation by the Customer:

The deposit and/or full payment made by the customer are non-refundable under any circumstances. Cancellation by the customer represents an operational loss for the Supplier. Therefore, no monetary refunds will be made. The only option available is rescheduling:
Rescheduling: The customer may move their reservation to another available business day within the following two weeks. If the rescheduling is requested less than 72 hours in advance, an administrative fee of 20% of the total value of the reservation may be applied.
No-Show: If you do not show up at the agreed time, 100% of the amount paid will be forfeited with no option to reschedule.

Cancellation by Gaby ll (Weather or Mechanical Failure)

Cancellation by the Supplier will only occur due to dangerous weather conditions (at the sole discretion of the Captain) or unforeseen mechanical failures.
In these cases, the following conditions will apply:
Priority Option: The first option will be to reschedule the excursion for a later business day.
Refund Only if there is no Rescheduling Option: A full refund of the amounts paid will only apply if you are unable to reschedule the excursion due to the end of your stay in the area or if the Supplier does not have available dates in their itinerary. If you have time to reschedule and refuse to do so, there will be no refund.
Safety, Conduct and Limits of Liability
The safety of all passengers is our top priority. The Captain of Gaby II has final authority over route decisions, safety matters, and the termination of the trip for any reason, including disruptive or dangerous passenger behavior. The use or possession of illegal drugs is strictly prohibited. Alcohol consumption must be moderate and responsible. The Provider assumes no liability for personal injury, loss, or damage to the client's property that occurs during the excursion, unless it results from proven gross negligence on the part of the Provider or its crew.
Applicable Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction where the Provider operates. Any legal dispute will be submitted to the competent courts in Guerrero, Mexico.
